Summary

Aging and disability alone do not indicate a lack of capacity. An older person or one with a disability may very well be able to make his or her own decisions without assistance. In some circumstances. this is not so and questions of capacity and guardianship are paramount. This workshop will address myths about guardianship and provide participants with insight into the evaluation of capacity and the determination of what is most appropriate for people at risk. It will also provide updates to Ohio Guardianship Rule 66.01-09 which took effect June 1, 2015.

Objectives:

  • Distinguish between decision-making capacity and competency
  • Discuss the criteria clinicians use to determine capacity
  • Identify common misconceptions about guardianship
  • Identify a process for determining the least restrictive and most appropriate alternatives for vulnerable adults
  • Identify components of Sup. Rule 66.01-09 which are relevant to those working with those under guardianship & their families in Ohio
